SIAC Jakarta Conference 2015

On 17 September 2015, SIAC held its SIAC Jakarta Conference at the Raffles Jakarta. The Conference was a sell-out event, attracting an impressive turnout of about 200 attendees, of which 33% were private practitioners, and about 40% were in-house counsel. The rest of the participants were arbitrators, members of the academe, public sector officials, and industry service providers.

The theme of the Conference was ‘The Rise and Rise of International Arbitration in Indonesia’, bringing into focus the steady and continuous growth of arbitration in the jurisdiction.

The Conference opened with a Welcome Address by Mr Cavinder Bull, SC, Vice-President, SIAC Court of Arbitration and Deputy Chairman, SIAC Board of Directors, while the Keynote Address was given by Mr M. I. Zikrullah, Vice Chairman of SKK Migas.

The interactive panel sessions for the SIAC Jakarta Conference were loosely structured to mirror the development of an international arbitration case. Thus, the first panel session provided corporate counsel with tools at the outset of a dispute, such as how to draft proper arbitration agreements and how to select the proper dispute resolution mechanism. It also emphasised the importance of properly selecting the seat of arbitration.

The second panel session, on the Arbitration of Oil and Gas Disputes, recognised the growth of arbitration as the means to resolve disputes in the oil and gas industry, which is one of Indonesia's major industries. The second panel also considered the proposed amendments to Indonesia’s Oil & Gas Law and how these may affect corporate counsel, and those with interests in oil and gas operations in Indonesia.

The third panel session discussed the expedited procedure under SIAC, and delved into the questions that may arise when users consider applying to have their cases brought under this procedure.

Lastly, the fourth panel session brought delegates to what happens after the close of an arbitration dispute – enforcement. This panel session specifically talked about enforcement under the Indonesian legal regime, taking into account the particular requirements under the Arbitration Law and relevant decisions of the Central Jakarta District Court, and deliberated on hot topics such as whether there is unpredictability in enforcing foreign awards in Indonesia, especially with regard to the judicial interpretation of public policy.
